Welcome to Language Island! These Terms of Service ("Terms") govern your access to and use of the Language Island mobile application and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Language Island, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use Language Island. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

3.1 Account Creation

To access certain features of Language Island, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.2 Account Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or for any other reason at our discretion.

4. Use License

4.1 Grant of License

Language Island grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

4.2 Restrictions

You agree not to:

• Copy, modify, or distribute the app or any content without permission
• Reverse engineer, decompile, or disassemble the application
• Remove any copyright or proprietary notices from the Service
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems or software to extract data from the Service
• Impersonate any person or entity or misrepresent your affiliation

5. User Content

5.1 Your Content

You may create custom sentences and other content within Language Island. You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content to provide and improve the Service.

5.2 Content Standards

You agree that your content will not:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Contain hateful, discriminatory, or offensive material
• Include spam, advertising, or promotional content
• Contain malware or harmful code

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without notice.

6. Intellectual Property

6.1 Our Content

All content provided by Language Island, including sentences, translations, audio recordings, images, designs, and software, is owned by Language Island or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks

The Language Island name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Language Island. You may not use these marks without our prior written permission.

7. Premium Features and Payments

7.1 Subscription Services

Language Island offers premium features through subscription plans. By purchasing a subscription, you agree to pay the fees specified at the time of purchase.

7.2 Billing

• Subscriptions automatically renew unless cancelled before the renewal date
• You authorize us to charge your payment method for all fees
• Prices may change with 30 days' notice
• All fees are non-refundable except as required by law

7.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

8. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third-party sites. Your use of third-party services is at your own risk and subject to their terms and conditions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of content

Language Island does not guarantee that you will achieve fluency or any specific learning outcomes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANGUAGE ISLAND SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages resulting from your use or inability to use the Service
• Any damages resulting from unauthorized access to your data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Language Island, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your content

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app with a new "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Language Island regarding the Service and supersede all prior agreements.

18. Additional Terms

18.1 Export Control

You agree to comply with all applicable export and re-export control laws and regulations.

18.2 Government Use

If you are a government entity, the Service is provided as "Commercial Computer Software" subject to applicable government acquisition regulations.

18.3 Force Majeure

Language Island shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
